In relation to the reserved seats of the Punjab Assembly, the decision of the Lahore High Court will be taken.

Analysis by Barrister Ali Zafar

As far as the National Assembly seats are concerned, they are specific seats that come from different provinces. This means that those who are elected from Balochistan, whether they are from Punjab, KPK, or Sindh, are all lumped together. The numbers are aggregated, and seats in the National Assembly are allocated accordingly. Similarly, each province has its own seats for its provincial assembly.

As far as the Peshawar High Court is concerned, it had issued directions regarding the seats of the National Assembly, which said that by-elections should not be held for certain seats of the National Assembly, irrespective of the province. . Similarly, regarding the KPK Assembly, the Peshawar High Court had said that the KPK Assembly will not take any specific seat. Peshawar High Court also has jurisdiction to decide on specific seats of Punjab Assembly.

Here specific seats of Sindh or Balochistan are not under the jurisdiction of Peshawar High Court. The decision on the issue of specific seats in the Punjab Assembly depends on the Lahore High Court. So, there is a big difference, and I think telegeneral is completely wrong. It is true that the specific seats of the Punjab Assembly will be decided by the Lahore High Court, but here it is about the National Assembly, so no High Court has the authority to give directions. Therefore, the interpretation of what Syed Siddiq is saying is wrong.

Presumably, the court has not informed the Election Commission in words and has not given any order, so they have taken a separate interpretation. Since court money is also in the public domain, there was no need for a special order to be sent to Sade. After being notified, action is essential. Whether it comes through the media, through direct interpretation, or through a formal letter, an order must be obeyed if communicated. It is important that a process is needed. If the court sends a formal order, it is a formal order, but if you have been notified and know that the order is against you, you cannot disobey it.
